They alleged that a Connecticut Interscholastic Athletic Conference (CIAC) policy allowing students to compete according to their gender identity violated their rights under Title IX.Chatigny ruled that because Soule and Mitchell had graduated they no longer faced any harm, and that Smith and Nicoletti did not face any continuing harm because there were no longer any transgender students competing against them.Smith and Nicoletti argued that the case should live on due to the possibility that such a situation could recur, but Chatigny ruled that this argument would only work if they themselves were at risk of facing harm, in which case they would be able to sue again."If it turns out that a transgender student does register to compete in girls' track next season, Smith and Nicoletti will be able to file a new action under Title IX along with a motion for a preliminary injunction," the judge ruled.ALABAMA GOV.
